Welcome to Throttle Chicks.

These Terms of Service (“Terms”) govern your access to and use of the Throttle Chicks website, online store, products and related services.

Throughout these Terms, the terms “Throttle Chicks,” “we,” “us,” and “our” refer to Throttle Chicks and its owner/operator, as applicable. The terms “you” and “your” refer to any visitor, customer or other user of our website or services.

By accessing our website, creating an account, placing an order or otherwise using our services, you agree to these Terms and any policies referenced within them.

If you do not agree with these Terms, please do not use our website or purchase our products.

1. ELIGIBILITY & USE OF OUR WEBSITE

By using this website, you represent that you have the legal capacity to enter into transactions through our website or that you are using the website with the involvement and permission of a parent or legal guardian where required.

You agree to use our website only for lawful purposes.

You may not use our website or services to:

  • Violate applicable laws or regulations;
  • Engage in fraudulent or deceptive activity;
  • Attempt unauthorized access to our website, accounts or systems;
  • Introduce malicious code, viruses or other harmful technology;
  • Scrape, harvest or improperly collect information from our website;
  • Interfere with the operation or security of our website;
  • Impersonate another individual or organization;
  • Submit false or misleading information; or
  • Use our content or intellectual property without authorization.

We reserve the right to restrict or terminate access to our services where reasonably necessary to protect Throttle Chicks, our customers or our systems, subject to applicable law.

2. PRODUCTS & SERVICES

Throttle Chicks sells apparel, accessories and related merchandise.

We make reasonable efforts to accurately display and describe our products, including colours, designs, sizing, materials and other characteristics.

However, the appearance of colours may vary depending on your device, screen settings and lighting conditions.

Because garments and other products may originate from different manufacturers or production batches, minor variations may occur.

Product photographs and mockups are intended to provide a reasonable representation of the product but may not perfectly represent every physical item.

3. MADE-TO-ORDER PRODUCTS

Most Throttle Chicks products are made to order.

Unless otherwise stated on a product page, customers should allow approximately 7–14 business days for production and processing before shipment.

This production period is separate from carrier transit time.

Our made-to-order model helps us reduce unnecessary production and waste, minimize excess inventory and offer products based on actual customer demand.

Because production may begin shortly after an order is placed, made-to-order products may not be eligible for cancellation, return or exchange for change of mind once production has begun.

Please review our Return & Refund Policy and Shipping Policy before placing an order.

4. PRODUCT AVAILABILITY

All products and services are subject to availability.

We reserve the right to:

  • Add or discontinue products;
  • Modify available sizes, colours or styles;
  • Limit quantities;
  • Change product specifications;
  • Temporarily suspend products;
  • End collections or promotions; and
  • Refuse or cancel orders where reasonably necessary.

A product appearing on our website does not guarantee indefinite availability.

Limited-edition, seasonal or special-release products may sell out or be discontinued without notice.

5. ORDERS

Submitting an order does not necessarily mean that the order has been finally accepted for fulfillment.

We reserve the right, where reasonably necessary and permitted by law, to refuse or cancel an order, including where:

  • A product is unavailable;
  • Pricing or product information contains an obvious error;
  • Payment cannot be authorized;
  • Fraud or unauthorized payment activity is reasonably suspected;
  • A promotional code has been misused;
  • An order violates purchase limits;
  • Fulfillment is not reasonably possible; or
  • The order otherwise violates these Terms.

If we cancel an order after payment has been successfully collected, we will refund the applicable amount unless another lawful resolution applies.

6. ORDER INFORMATION

You agree to provide current, complete and accurate information when placing an order.

This includes your:

  • Name;
  • Billing information;
  • Shipping address;
  • Email address; and
  • Other information reasonably required to process your purchase.

You are responsible for reviewing your information before submitting an order.

If you discover an error after ordering, please contact us as soon as possible.

We cannot guarantee that changes can be made after an order has entered production or shipment.

7. PRICES

Unless otherwise stated, prices displayed on the Throttle Chicks website are shown in the currency indicated by the website or checkout.

Prices may change without notice.

Price changes do not normally affect orders that have already been accepted and paid, except where required to correct an obvious error or as otherwise permitted by law.

Applicable taxes and shipping charges will be calculated or displayed during checkout where required.

8. PRICING & WEBSITE ERRORS

Although we make reasonable efforts to ensure that website information is accurate, mistakes may occasionally occur.

These may include errors involving:

  • Pricing;
  • Product descriptions;
  • Discounts;
  • Inventory;
  • Shipping rates;
  • Product images;
  • Sizes;
  • Promotional offers; or
  • Other website information.

If an obvious error affects your order, we may contact you to explain the issue and provide available options, which may include correcting the order or cancelling it and issuing an appropriate refund.

We are not obligated to honour an obviously erroneous price where doing so is not required by applicable law.

9. PAYMENT

Payment must be successfully authorized through one of the payment methods offered at checkout.

Payment processing may be provided by third-party payment providers.

Throttle Chicks does not necessarily directly receive or store complete payment-card information.

Your use of a third-party payment provider may also be subject to that provider’s terms and privacy practices.

10. DISCOUNTS & PROMOTIONAL CODES

Discounts and promotional codes are subject to the terms of the applicable promotion.

Unless otherwise stated:

  • Promotional codes cannot be combined;
  • Codes have no cash value;
  • Discounts cannot be applied retroactively to previous purchases;
  • Codes may expire;
  • Certain products may be excluded;
  • Minimum purchase requirements may apply; and
  • Promotions may be modified or discontinued where permitted by law.

We reserve the right to reject or cancel discounts obtained through fraud, technical errors, unauthorized distribution or intentional misuse.

11. AMBASSADOR, AFFILIATE & PERSONAL DISCOUNT CODES

Certain discount codes may be issued specifically to Throttle Chicks ambassadors, affiliates or other approved individuals.

Personal-use codes are intended only for the person to whom they were issued unless expressly stated otherwise.

Shareable ambassador or affiliate codes may be distributed according to the applicable program rules.

Misuse may include, where applicable:

  • Publicly distributing a code designated for personal use;
  • Using multiple accounts to circumvent restrictions;
  • Manipulating orders to generate commissions or rewards improperly;
  • Using unauthorized coupon websites to distribute restricted codes;
  • Creating fraudulent transactions;
  • Self-referrals where prohibited by the applicable program; or
  • Otherwise attempting to obtain benefits contrary to the program’s stated rules.

Throttle Chicks may disable a code, reverse improperly obtained rewards or terminate participation in an ambassador or affiliate program where there is reasonable evidence of abuse, subject to the applicable program terms and law.

Participation in any ambassador or affiliate program may also be governed by separate terms.

12. GIFT CARDS & STORE CREDIT

Gift cards and store credits, where offered, are subject to applicable terms and laws.

They may not be redeemed for cash except where required by law.

Gift cards should be treated like cash. Throttle Chicks is not responsible for unauthorized use resulting from a customer voluntarily sharing gift-card information, except where required by law.

13. SHIPPING

Orders are shipped according to our current Shipping Policy.

Most products require approximately 7–14 business days of production before shipment, unless otherwise stated.

Shipping estimates are separate from production times.

Carrier delays, customs processing, weather, labour disruptions and other events outside our reasonable control may affect delivery.

14. UNITED STATES & INTERNATIONAL ORDERS

Customers purchasing from outside Canada acknowledge that cross-border transactions may be subject to customs requirements, tariffs, duties, taxes, regulatory requirements and carrier procedures.

Throttle Chicks will comply with applicable shipping and customs requirements associated with the shipping service used.

Any additional recipient charges not collected or prepaid by Throttle Chicks remain the customer’s responsibility where permitted by applicable law.

Cross-border delivery may take longer due to customs or border processing.

15. RETURNS, EXCHANGES & REFUNDS

Returns, exchanges, cancellations and refunds are governed by our Return & Refund Policy.

Because most Throttle Chicks products are made to order, we generally do not accept returns or provide refunds solely because of:

  • Change of mind;
  • Buyer’s remorse;
  • Incorrect size selection by the customer;
  • Colour preference; or
  • Other personal-preference reasons,

except where required by applicable law or expressly permitted under our Return & Refund Policy.

Nothing in these Terms eliminates rights or remedies that cannot legally be excluded.

16. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

If you receive a damaged, defective or incorrect item, please contact us promptly according to our Return & Refund Policy.

We may request photographs, order information or other reasonable evidence necessary to investigate the issue.

Where a claim is confirmed, we will provide an appropriate remedy consistent with our policies and applicable law.

17. INTELLECTUAL PROPERTY

Unless otherwise stated, the Throttle Chicks website and its original content are owned by or licensed to Throttle Chicks.

This may include:

  • Brand names;
  • Logos;
  • Artwork;
  • Apparel graphics;
  • Product designs;
  • Photographs;
  • Videos;
  • Website graphics;
  • Written content;
  • Collection names and campaign materials where legally protectable; and
  • Other original creative materials.

Our content may be protected by copyright, trademark and other intellectual-property laws.

You may not reproduce, copy, modify, distribute, sell, commercially exploit or create unauthorized derivative works from Throttle Chicks content without appropriate permission.

Purchasing a physical product does not transfer ownership of the intellectual property appearing on that product.

18. TRADEMARKS & BRAND IDENTITY

The Throttle Chicks name, logos, designs and associated branding may constitute trademarks or other protected brand identifiers.

Nothing contained on this website grants permission to use Throttle Chicks trademarks, logos or branding for commercial purposes without prior authorization.

19. CUSTOMER PHOTOS, REVIEWS & USER CONTENT

You may have opportunities to submit reviews, photographs, comments, testimonials or other content.

You remain responsible for content you submit and represent that you have the necessary rights to provide it.

Submitting content through a review feature does not automatically give Throttle Chicks unlimited rights to use your photograph or likeness in unrelated advertising.

If we wish to use identifiable customer-created content for promotional or marketing purposes beyond what is reasonably necessary to display the content in the feature through which it was submitted, we may request appropriate permission where required.

You may not submit content that is unlawful, fraudulent, defamatory, threatening, infringing or otherwise violates the rights of another person.

20. SOCIAL MEDIA

Throttle Chicks may operate accounts on third-party social-media platforms.

Those platforms are operated independently and are subject to their own terms, policies and availability.

References to, tags from or interactions with Throttle Chicks on social media do not necessarily constitute endorsement or sponsorship.

Giveaways, contests or promotions may be subject to separate rules.

21. THIRD-PARTY SERVICES

Our website may rely on or link to third-party services, including payment processors, shipping carriers, ecommerce technology providers, social-media platforms and other service providers.

Throttle Chicks does not control the independent operation, content or policies of third-party services.

Use of those services may be governed by separate terms.

22. WEBSITE AVAILABILITY

We aim to keep our website accessible and functioning properly, but uninterrupted access cannot be guaranteed.

The website may occasionally be unavailable because of:

  • Maintenance;
  • Technical problems;
  • Software updates;
  • Hosting interruptions;
  • Security issues; or
  • Circumstances outside our reasonable control.

We may modify, suspend or discontinue portions of the website where reasonably necessary.

23. ACCOUNTS

If customer accounts are available, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account to the extent reasonably within your control.

Please notify us if you believe your account has been accessed without authorization.

We may suspend accounts where reasonably necessary to investigate suspected fraud, abuse or security concerns.

24. PROHIBITED COMMERCIAL USE

Throttle Chicks products are intended for personal use unless otherwise agreed.

You may not purchase products for unauthorized resale, reproduce our products for commercial purposes or represent yourself as an authorized Throttle Chicks retailer, distributor or representative without written permission.

Wholesale or authorized resale arrangements, where offered, are subject to separate agreements.

25. FRAUD & ABUSE

We reserve the right to investigate transactions where there is reasonable evidence of:

  • Fraud;
  • Unauthorized payment activity;
  • Chargeback abuse;
  • Return abuse;
  • Promotional-code manipulation;
  • False claims;
  • Account manipulation; or
  • Other misuse of our services.

Where permitted by law, we may cancel transactions, restrict accounts, refuse future orders or provide relevant transaction information to payment processors, carriers or authorities where reasonably necessary to investigate or respond to suspected fraud.

26. CHARGEBACKS & PAYMENT DISPUTES

If you experience an issue with an order, we encourage you to contact Throttle Chicks so that we have an opportunity to investigate and resolve the matter.

If a chargeback or payment dispute is initiated, we may provide relevant records to the applicable bank, card issuer or payment processor, including:

  • Order information;
  • Tracking and delivery records;
  • Customer communications;
  • Applicable policies;
  • Production records; and
  • Other relevant transaction information.

Nothing in this section limits your lawful right to dispute an unauthorized or legitimately disputable transaction.

27. PRODUCT USE & CARE

Customers are responsible for following applicable product-care instructions.

Throttle Chicks is not responsible for ordinary deterioration or damage caused by misuse, improper laundering, improper drying, modification, neglect or failure to follow care instructions, except where otherwise required by law.

28. MOTORSPORTS DISCLAIMER

Throttle Chicks is a motorsports-inspired apparel and lifestyle brand.

Unless a product is expressly identified and certified as protective equipment, Throttle Chicks apparel and accessories are not safety equipment or protective riding gear.

Wearing Throttle Chicks apparel does not provide protection against the inherent risks associated with motorcycles, ATVs, snowmobiles, racing, off-road vehicles or other motorsports activities.

Customers are responsible for using appropriate certified protective equipment and complying with applicable laws, rules and safety requirements when participating in motorsports activities.

Throttle Chicks does not encourage unsafe, reckless or unlawful operation of any vehicle.

29. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Throttle Chicks will not be liable for indirect, incidental, special or consequential losses arising solely from use of our website, products or services where such liability may lawfully be excluded or limited.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including applicable statutory consumer rights.

30. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Throttle Chicks from third-party claims, losses or reasonable expenses arising directly from your unlawful use of our website, infringement of another person’s rights or material violation of these Terms.

This provision does not apply where prohibited by applicable consumer law.

31. PRIVACY

Personal information collected through our website is handled according to our Privacy Policy and applicable privacy law.

Please review our Privacy Policy for information regarding how personal information is collected, used, disclosed and protected.

32. FORCE MAJEURE

Throttle Chicks will not be responsible for delays or failures caused by circumstances outside our reasonable control to the extent permitted by law.

These circumstances may include severe weather, natural disasters, fires, floods, labour disruptions, transportation interruptions, carrier disruptions, government actions, customs interruptions, supply-chain disruptions, telecommunications failures or other extraordinary events.

Where such an event materially affects an order, we will make reasonable efforts to communicate with affected customers and determine an appropriate resolution.

33. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our business, website, products, services or legal requirements.

The current version will be posted on our website with an updated “Last Updated” date.

Changes will apply prospectively except where otherwise permitted or required by law.

Your continued use of the website after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

34. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

35. NO WAIVER

Failure by Throttle Chicks to enforce a provision of these Terms on one occasion does not necessarily waive the right to enforce that provision in the future.

36. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy and any additional terms expressly applicable to a particular promotion, program or transaction, constitute the agreement governing your use of our website and purchases from Throttle Chicks.

37. GOVERNING LAW

These Terms are governed by the laws applicable in the Province of Ontario and the federal laws of Canada applicable therein, subject to any mandatory consumer-protection laws that apply based on the customer’s location.

Nothing in this section deprives a consumer of protections that cannot lawfully be waived or restricted.
